Exclusion and Restriction of Sick Employees

Employees report illness; the person in charge excludes or restricts them.

19 steps15 criticalLimit 5 minAlways tested

Steps

  1. 1Require food employees and conditional employees (new hires) to report their health to the person in charge; the permit holder sets this up, the employee reports, and the person in charge acts
  2. 2Employees report these symptoms: vomiting, diarrhea, jaundice, sore throat with fever, and a boil or infected wound with pus that is open or draining and not properly covered
  3. 3Employees report a diagnosis from a health practitioner of norovirus, hepatitis A, Shigella, Shiga toxin-producing E. coli, typhoid fever (Salmonella Typhi) or nontyphoidal Salmonella
  4. 4Critical stepEmployees also report typhoid fever within the past three months without antibiotic therapy, and exposure to a confirmed outbreak, as the Code lists
  5. 5Critical stepExclude an employee with vomiting or diarrhea, unless the symptom is from a noninfectious condition
  6. 6Critical stepExclude an employee whose jaundice began within the last 7 calendar days, unless written medical documentation from a health practitioner says it is not hepatitis A or another fecal-oral infection
  7. 7Critical stepExclude an employee diagnosed with hepatitis A or typhoid fever
  8. 8Critical stepExclude an employee diagnosed with norovirus, Shigella, Shiga toxin-producing E. coli or nontyphoidal Salmonella who has vomiting or diarrhea. With no symptoms: for norovirus, Shigella and STEC, exclude if you serve a highly susceptible population and restrict if you do not; for nontyphoidal Salmonella, restrict in either case
  9. 9Critical stepSore throat with fever: exclude if the operation serves a highly susceptible population, restrict if it does not
  10. 10Critical stepBoil or infected wound that is open or draining and not properly covered: restrict; cover it with an impermeable cover and a single-use glove on the hand, finger or wrist, an impermeable cover on the arm, or a dry, durable, tight-fitting bandage elsewhere
  11. 11Critical stepThe person in charge notifies the regulatory authority when an employee is jaundiced or diagnosed with one of the six listed illnesses
  12. 12Critical stepReinstate an employee excluded for vomiting or diarrhea with no diagnosis after at least 24 hours without symptoms, or with written medical documentation from a health practitioner that the symptom is noninfectious
  13. 13Critical stepNorovirus: reinstate an excluded or restricted employee only with regulatory approval and one of these: written medical documentation from a health practitioner that the employee is free of norovirus; more than 48 hours since vomiting or diarrhea resolved; or, if no symptoms developed, more than 48 hours since diagnosis
  14. 14Critical stepShigella: reinstate an excluded or restricted employee only with regulatory approval and one of these: written medical documentation of freedom from Shigella based on 2 consecutive negative stool cultures taken at least 24 hours apart and not earlier than 48 hours after antibiotics stopped; more than 7 calendar days since vomiting or diarrhea resolved; or, if no symptoms developed, more than 7 calendar days since diagnosis
  15. 15Critical stepShiga toxin-producing E. coli: reinstate an excluded or restricted employee only with regulatory approval and one of these: written medical documentation of freedom from the infection based on 2 consecutive negative stool cultures taken at least 24 hours apart and not earlier than 48 hours after antibiotics stopped; more than 7 calendar days since vomiting or diarrhea resolved; or, if no symptoms developed, more than 7 days since diagnosis
  16. 16Critical stepNontyphoidal Salmonella: reinstate an excluded or restricted employee only with regulatory approval and one of these: written medical documentation of freedom from Salmonella based on 2 consecutive negative stool cultures taken at least 24 hours apart and not earlier than 48 hours after antibiotics stopped; a restricted employee more than 30 days since vomiting or diarrhea resolved; or, if no symptoms developed, more than 30 days since diagnosis
  17. 17Critical stepHepatitis A or jaundice: reinstate an excluded employee only with regulatory approval and one of these: jaundiced for more than 7 calendar days; an employee without jaundice symptomatic with other symptoms for more than 14 calendar days; or written medical documentation from a health practitioner that the employee is free of a hepatitis A virus infection
  18. 18Critical stepTyphoid fever: reinstate an excluded employee only with regulatory approval and written medical documentation from a health practitioner that the employee is free from typhoid fever
  19. 19Sore throat with fever: reinstate an excluded or restricted employee only with written medical documentation from a health practitioner that the employee has had antibiotic therapy for Streptococcus pyogenes infection for more than 24 hours, has at least one negative throat culture for it, or is otherwise determined to be free of it

What graders are watching for

Tips
  • Exclude means the person may not work in the establishment as an employee. Restrict means the person may not work with exposed food, clean equipment, utensils, linens or unwrapped single-use items.
  • The 24-hours-without-symptoms rule is for vomiting or diarrhea with no diagnosis. A diagnosed illness has its own conditions and needs regulatory approval.
  • Whether you serve a highly susceptible population changes the action for sore throat with fever and for norovirus, Shigella and STEC infections with no symptoms.

Common mistakes

  • Letting a vomiting or diarrhea employee work a lighter job, which is restriction rather than exclusion.
  • Sending an employee back after one good day instead of 24 hours without symptoms.
  • Using the 24-hour rule for a diagnosed illness.
  • Accepting a verbal statement that jaundice is not hepatitis A.
